These Terms and Conditions ("Terms") govern your access to and use of our website and our delivery-only bakery services, including the purchase and delivery of cookies, tarts, confections, and other baked goods (collectively, the "Services"). By accessing our website, placing an order, or otherwise using our Services, you agree to be legally bound by these Terms. If you do not agree, please do not use our website or Services.

1. Eligibility to Use Our Services

By using this website, you confirm that you are at least the age of majority in the Province of Ontario (18 years old) and have the legal capacity to enter into a binding agreement. If you are using this site on behalf of another person or entity, you represent that you have authority to bind them to these Terms.

We prepare and sell freshly made baked goods, including but not limited to cookies, bars, squares, loaves, tarts, and confections (the "Products"). All Products are made to order or in small batches and are intended for consumption shortly after delivery.

Product descriptions, photographs, and pricing are provided for convenience and illustrative purposes only. While we make reasonable efforts to ensure accuracy, slight variations may occur due to the handmade nature of our Products.

4. Ordering and Contract Formation

When you place an order through our website:

  • You are making an offer to purchase Products subject to these Terms;

  • A binding contract is formed only once we accept your order and issue an order confirmation;

  • We reserve the right to refuse or cancel any order at our discretion, including due to availability, pricing errors, or suspected misuse of our Services.

5. Pricing, Taxes, and Payment

All prices are listed in Canadian dollars (CAD) and are subject to applicable federal and provincial taxes, including HST, unless otherwise stated.

Payment must be made in full at the time of ordering. We accept the payment methods displayed at checkout. Lily & Crumb reserves the right to change prices at any time prior to order acceptance.

Lily & Crumb operates as a delivery-only bakery.

  • Delivery is available only within our designated delivery area in Ontario.

  • Delivery dates and time windows are estimates and are not guaranteed.

  • You are responsible for providing accurate delivery information and ensuring safe access to the delivery location.

  • Risk of loss or damage to Products transfers to you upon delivery to the address provided.

We are not responsible for delays or failures caused by factors beyond our reasonable control, including weather, traffic, or incorrect delivery details.

7. Allergens and Food Safety Disclaimer

Our kitchen handles ingredients that may include wheat, gluten, dairy, eggs, nuts, peanuts, soy, and other common allergens. While we may provide ingredient information upon request, Lily & Crumb does not guarantee that any Product is allergen-free.

By placing an order, you acknowledge and accept full responsibility for determining whether Products are suitable for you or your recipients. Lily & Crumb is not liable for allergic reactions or adverse health effects.

8. Cancellations, Returns, and Refunds

Due to the perishable nature of baked goods:

  • All sales are final.

  • We do not accept returns.

If you believe your order is incorrect, damaged, or unsatisfactory, you must notify us within 24 hours of delivery and provide reasonable details and photos where applicable. Any refunds, credits, or replacements are provided at our sole discretion and in accordance with Ontario consumer protection laws.

9. Consumer Rights (Ontario)

Nothing in these Terms limits your rights under the Consumer Protection Act, 2002 (Ontario). If any provision of these Terms conflicts with applicable consumer protection legislation, the legislation will prevail.

10. Intellectual Property

All content on this website, including text, images, logos, product designs, and branding, is the property of Lily & Crumb or its licensors and is protected under Canadian intellectual property laws. You may not copy, reproduce, distribute, or use any content without prior written consent.

Our total liability for any claim shall not exceed the amount paid by you for the specific order giving rise to the claim.
